Start your agreement with your names and the date the agreement is signed and witnessed. (Witnesses watch you sign and then they sign.)

These clauses in your agreement set out the facts and descriptions, including

• names and birth dates of children,
• information about your occupations and incomes, and
• details about family property.

These clauses show that:

• you both know about and agree upon certain important information, and
• you understand that this information is important to the agreement.

Include only the clauses that apply to your situation and agreement.

Include all the clauses that apply.

• If you lived together, include clause 1 and type in the date you started living together.
• If you were married, include clause 2, and type in the date and the location you got married. Include both clause 1 and clause 2 if you lived together before you got married.
• If you and the other person have been living separate and apart, include clause 3. Type in the date you started living apart.
• If you lived separate and apart but in the same residence for a time, include clause 4.
  • Type in the date you started living separately but in the same residence.
  • Type in the date you moved into different residences.

Include all the clauses that apply.

• Include clause 7 if you have children.
  • Type in each child's name and birthdate starting at clause 8.
• Include clause 12 If you have children over 19 who need financial support.
  • Type in the reason they need support. (For example, they're attending a post-secondary school, or they have a disability.)
  • Type in the name and birthdate of each of these children starting at clause 13.

• Include clauses 15 – 19 as needed to specify what the agreement addresses.
• Include clause 21 if your agreement is an interim (temporary) agreement, and include clauses 22 and 23 if they apply.

If you have any other agreements or orders that related to your marriage or separation, refer to them when filling in these clauses.

Include all the clauses that apply.

• Include clause 24 if there are no court proceedings.
• Include clause 25 if there are court proceedings under way but not concluded.
• Include clause 26 if there are court proceedings that resulted in orders, and type in
  • the court registry where your family law case was started,
  • the court location,
  • the court file number,
  • whether the court made its orders after a hearing or by consent, and
  • the order details in clause 27.
• Include clause 28 if this agreement adds to an agreement already made. Type in the date of the existing agreement.
• Include clause 29 if this agreement replaces an agreement already made. Type in the date of the existing agreement.

• Include clause 30 if you plan to apply for an uncontested (undefended) divorce. Click the name of the person who will apply to the court for a divorce. The field will update with your names.
